1. General provisions: definitions
1.1 In these General Visitors Conditions, the following terms have the following meaning.
Museum: “Stichting Centraal Museum” is the civil-law foundation that, in conformity with its stated objective, opens to the public the buildings known locally as “het Centraal Museum”, “het Nijntje Museum” and “het Rietveld Schröderhuis”, for museum purposes.
Museum Building: The complex of areas (both built and non-built) opened to the public and forming part of, or belonging to, the buildings known locally as “het Centraal Museum”, “het Nijntje Museum” and “het Rietveld Schröderhuis”.
Visitor: Any person entering the Museum Building.
Admission Ticket: A valid ticket giving the Visitor access to the public areas of the Museum Building during regular opening hours or during time slots communicated to the Visitor.
Group: Two or more Visitors for whom a guided tour has been booked, or at least ten
Visitors visiting a Museum Building as a group.
Product(s): Any product offered or sold by the Museum.
Agreement: An agreement for the purchase and delivery of Products or an Admission
Ticket.
Visitors Conditions: These General Visitors Conditions.
Offer: Any offer made by the Museum for the purchase and delivery of Products or an
Admission Ticket.
Officer: A natural person, appointed by and working for the Museum and
recognisable as such.
2. Applicability
2.1 The Visitor Terms and Conditions apply to all Visitors.
2.2 Any derogation from the Visitors Conditions is valid only if agreed in writing.
3. Access to the Museum Building
3.1 A Visitor is permitted to enter the Museum Building only on presentation of a valid Admission Ticket.
3.2 A Visitor may be denied access to the Museum Building if:
a. the Visitor’s Admission Ticket, the discount pass or voucher was not obtained from the Museum or from another agency authorised by the Museum;
b. the Visitor is under the influence of alcohol, narcotics or similar substances;
c. the Visitor disturbs or has the intention to disturb public order;
d. the Visitor wishes to enter the Museum Building bare-foot and/or bare-chested;
e. the Visitor refuses to show personal identification upon entering the Museum Building;
f. the Visitor wears face-covering garments and refuses to show his or her face for the purpose of identification upon entering the Museum Building;
g. the Visitor is unwilling to cooperate with an inspection of items used to carry
hand luggage, such as bags, small backpacks and pushchairs.
3.3 An Admission Ticket’s validity expires by the mere expiry of the date or time slot stated on the ticket.
3.4 The Visitor is at all times obliged, upon request, to present to the Officer the Admission Ticket and any pass or voucher granting a discount to the admission price, in combination with a valid identity document if requested. The Admission Ticket must be presented upon each entry to the Museum Building.
3.5 The Museum is entitled to adjust its regular opening hours:
a. for occasional emergency response drills;
b. in the event of an emergency, for a full or partial evacuation of the Museum building deemed necessary by the Museum.
3.6 The Museum will, as far as reasonably possible, inform the Visitor:
a. the full, partial or early closure of the Museum Building; and/or
b. exhibitions organised by the Museum, maintenance work, renovations or refurbishment work on or to (parts of) the Museum Building. A Visitor may not derive any rights from this information.
3.7 It is not permitted to carry bags, backpacks, umbrellas, baby back carriers, children’s prams (with the exception of strollers), substances and objects that may cause harm to people and objects, or to carry other large items. Items to a size of 30x30x15cm, foldable or not, can be left in the wardrobe of the Museum Building. The Museum may refuse to store larger items.
4. Visiting the Museum Building
4.1 A Visitor's visit to the Museum Building is at their own expense and risk.
4.2 A Visitor must behave in accordance with the Visitor Terms and Conditions and comply with directions and instructions given by Officers.
4.3 If the Museum finds that a Visitor has violated the Visitors Conditions in any way, he or she may be barred from further access to the Museum Building, without obliging the Museum to compensate for any damages or to refund any costs.
4.4 If a Visitor repeatedly violates the Visitors Conditions or the instructions or directions given by an Officer, the Museum can deny the Visitor access to the Museum Building for a certain period of time. The Museum will inform the Visitor of the decision to deny him or her access to the Museum Building.
4.5 Visitors under the age of twelve may visit the Museum Building only when accompanied by an adult. Parents and/or Supervisors are fully responsible and liable for the conduct of Visitors under the age of twelve. Among other things, they must ensure that Visitors under the age of twelve do not touch the objects on display.
4.6 Supervisors of Groups are fully responsible and liable for the conduct of the Group they supervise. They must accompany the Groups throughout the visit to the Museum Building and follow the instructions of Staff Members. Among other things, they must ensure that the Visitors they supervise do not touch the objects on display.
4.7 For primary schools, each Group of up to fifteen pupils must be accompanied by at least two Supervisors. For secondary schools, each Group of fifteen pupils must be accompanied by at least one Supervisor. The Museum may refuse admission to Groups that do not meet the number of Supervisors stipulated above in this article.
4.8 For guided tours guided by an Officer, the maximum group size is fifteen Visitors. For tours guided by someone from outside the Museum, the maximum group size is twenty Visitors.
4.9 Inside the Museum Building, Visitors are not permitted to:
a. offer goods of any kind to another Visitor;
b. intentionally and persistently obstruct other Visitors' passage or view of objects on display;
c. disturb other Visitors by making excessive noise, including, but not limited to, the use of mobile phones and portable audio equipment;
d. run or shout in the Museum Building;
e. bring in pets or other animals, with the exception of assistance animals, such as guide dogs;
f. possess or consume substances prohibited by law in the Museum Building;
g. consume food or beverages;
h. touch works of art;
i. touch objects on display or exhibition materials such as display cases, lighting and partitions;
j. use folding bicycles, Segways, hoverboards, smart balance wheels, roller skates, skateboards, kick scooters or similar means of transport;
k. cross physical or visual barriers;
l. bring in liquids or objects that could cause injury to people or damage to objects, or other large objects.
4.10 The following items may not be taken into the Exhibition Areas:
a. backpacks, bags larger than A4 size and back-mounted child carriers;
b. prams (excluding pushchairs);
c. wet clothing and umbrellas;
4.11 Mobility scooters are permitted, provided they do not exceed 120 cm in length, 70 cm in width and 109 cm in height. Before entering with a mobility scooter, a Staff Member may ask the Visitor about its speed and request that the Visitor demonstrate their ability to operate it. In exceptional circumstances, for example when the Museum is very busy, a Staff Member may decide not to admit the mobility scooter to the Museum. In that case, the Museum will consult with the Visitor to determine whether it is possible to visit the Museum in another way or at another time.
4.12 Parents and/or Supervisors of Visitors who are minors, and Supervisors of Groups, are liable for any damage caused by a Visitor under their supervision or responsibility.
4.13 Without the Museum's prior written consent, Visitors are prohibited from taking photographs, videos or film recordings using lights, flash equipment, selfie sticks or tripods. Visitors are also prohibited from publishing or reproducing such material in any manner or on any medium, except for clearly non-commercial purposes.
4.14 The Museum may permanently or temporarily deny access to the Museum Building to any Visitor who, during one or more previous visits to another museum, intentionally damaged an object or otherwise behaved improperly.
4.15 CCTV surveillance is in operation around and inside the Museum Building. CCTV footage is retained in accordance with the Dutch Personal Data Protection Act and, where necessary, made available to the police.
4.16 In the event of an emergency, the Museum is entitled to close the doors of the Museum Building and escort Visitors outside. Any Visitor may be asked to cooperate with an inspection of bags, carts and other items by or on behalf of an Official. A Visitor who refuses to cooperate must provide identification to an Official before leaving the Museum Building.
4.17 In the garden belonging to the Museum Building, it is not permitted to consume food or beverages brought onto the premises, ride bicycles, barbecue or light an open fire.
4.18 Flying drones above the Museum Building and/or the garden belonging to the Museum Building is prohibited.
4.19 Smoking is prohibited in the Museum Building, including the use of e-cigarettes.
5. Refunds
5.1 A Visitor is not entitled to a refund of the admission price or any other compensation in the event that the Admission Ticket is lost or stolen outside the Museum Building.
5.2 If a Visitor does not use the Admission Ticket, this is at the Visitor’s own expense and risk. This also applies if the Admission Ticket is valid only for a specific time or date.
5.3 An expired and unused Admission Ticket cannot be exchanged for a new and valid Admission Ticket. Nor will a refund be issued in such a case.
5.4 Refunds are not offered as a result of complaints by a Visitor relating to:
a. objects from the Museum’s permanent collection not being on display;
b. the Museum Building being partially closed, including, but not limited to, partial closure due to the installation or dismantling of exhibitions;
c. changes to regular opening hours in connection with emergency response drills or an emergency;
d. nuisance or inconvenience caused by other Visitors, including noise nuisance, inappropriate behaviour, theft and assault;
e. nuisance or inconvenience caused by maintenance work on, or the renovation or (re)design of, the Museum Building;
f. nuisance or inconvenience caused by facilities in the Museum Building not functioning properly;
g. nuisance or inconvenience caused by (large) crowds.
6. Liability of the Museum
6.1 The Museum shall never be liable for any damage arising from quotations, statements or other information provided to a Visitor by the Museum and/or third parties. Unless a Visitor demonstrates that the damage is a direct result of wilful misconduct or gross negligence on the part of the Museum, neither the Museum nor any third parties engaged by the Museum shall under any circumstances be liable to a Visitor for damage or loss of any kind suffered in connection with the Agreement or its performance. Under no circumstances shall the Museum be liable for any indirect damage suffered by a Visitor in this regard.
6.2 Under no circumstances shall the Museum be liable for damage suffered by a Visitor as a result of or caused by:
a. a failure by the Museum to perform the Agreement that cannot be attributed to the Museum, as referred to in Article 7 of these Visitor Terms and Conditions (“Force Majeure”);
b. an infringement of a third party’s intellectual and/or industrial property rights in connection with the Products supplied;
c. failure to follow instructions given by an Official and failure to comply with the Visitor Terms and Conditions;
d. other Visitors;
e. the Museum taking Visitors’ property into safekeeping.
6.3 In the event of liability as referred to in Article 6.1, the extent of such liability shall in any event be limited to:
a. the amount of the admission fee actually paid and the travel expenses actually incurred in connection with the matter; or
b. the amount paid to the Museum in connection with the matter by the Museum’s insurer; or
c. the amount of compensation received by the Museum from a third party in respect of the damage, whereby the Museum’s liability in any specific case of damage shall be limited to the lowest of the amounts referred to above under a. through c.
7. Force Majeure
7.1 The Museum cannot be held liable for any damage caused by a failure on its part resulting from force majeure. The Museum may in any event invoke force majeure in circumstances that temporarily or permanently prevent the Museum from performing the Agreement.
7.2 Circumstances as referred to in paragraph 1 of this article include, but are not limited to, natural disasters, strikes, terrorist attacks, power outages and disruption caused by construction work.
8. Processing of data
8.1 The Museum processes personal data in its capacity as data controller in accordance with the General Data Protection Regulation (‘GDPR’) when a Visitor uses our services and/or provides such data to us by completing a form on the Museum’s website. When processing this personal data, we respect the Visitor’s privacy and never process more personal data than is necessary.
9. Lost Property
9.1 Any items found by a Visitor in the Museum Building must be handed in at the shop counter, the information centre or to a Staff Member.
9.2 The Museum will make reasonable efforts to identify the owner of or person entitled to the found item. Found items for which no owner or entitled person has contacted the Museum within six (6) months of their being handed in as referred to in paragraph 1 of this Article 8 will be donated to a charitable organisation, at the Museum’s discretion.
9.3 The owner or entitled person may choose either to collect the found item in person or to have it sent cash on delivery. In either case, the owner or entitled person must provide proof of identity.
10. Complaints
10.1 Visitors may submit complaints and suggestions for improvement in writing or by email to info@centraalmuseum.nl. The Visitor's complaint will be investigated and answered in writing within 30 days.
11. General provisions
11.1 If any provision of the Visitor Terms and Conditions is null and void or is annulled, the remaining provisions of the Visitor Terms and Conditions shall remain valid and in force, and the null and void or annulled provision shall be replaced by a valid provision that corresponds as closely as possible to the substance of the original provision.
11.2 The Museum is entitled to have its obligations arising from the provisions of the Visitor Terms and Conditions performed in whole or in part by qualified third parties.
12. Governing law and competent court
12.1 The Agreement and these Visitor Terms and Conditions shall be governed by Dutch law.
12.2 All disputes arising in connection with the Agreement and the Visitor Terms and Conditions shall be settled exclusively by the competent court of the District Court of Midden-Nederland, Utrecht location.
13. Availability for inspection
13.1 These Visitor Terms and Conditions are available for inspection by anyone at the Museum's information desk and are published and available for download on the Museum's website.
